Licence to Publish (Journals)

EMAN RESEARCH Publishing requires a completed and signed Licence to Publish form before we can publish the journal paper.

To help you understand the various forms, we have set out the different types of Licence to Publish forms below (together with a sample copy of the forms). If you have any questions, please contact us at office@emanresearch.org.

Under all Licence to Publish forms, the copyright owner(s) retain their copyright.

The first decision is whether you wish your paper to be published as open access or not (if publishing in a hybrid journal). Once you have made this decision, you will need to select which of two Licence to Publish forms is appropriate for you.

 

Eman Research Publishing cancellations/refund policy

In circumstances where the corresponding author wishes to cancel the payment order and provide alternative funder details (for example, if an author failed to provide funding / grant / institution information in order to secure payment from their funding body or institution, and asks to cancel the order so they can submit this information), Eman Research Publishing will allow the order to be cancelled and a full refund given. A refund will otherwise only be given in exceptional circumstances and will be decided on a case-by-case basis.

In the case an article is retracted from publication, no refund for author payments will be given.

1. Open access journal papers

If you wish your paper to be published as open access, the copyright owner(s) will grant to EMAN RESEARCH Publishing a non-exclusive copyright licence under the relevant Licence to Publish form.

We have two types of open access Licence to Publish forms:

        a. Open Access Licence to Publish form (corresponding author signs on behalf of all authors) 

This Licence to Publish form can only be used where:

  • the corresponding author is the sole author and owns the copyright in the paper; or

  • the corresponding author is one of two or more authors and they jointly own the copyright in the paper.

If one or more of the authors do not own the copyright in the paper e.g., if their employer owns the copyright in the paper, then please see our other form: Open Access Licence to Publish form (all copyright owners sign).

If the corresponding author does not wish, or does not have the authority, to sign on behalf of the other authors, then please see our other form: Open Access Licence to Publish form (all copyright owners sign).

As a general guidance, academics of universities usually own the copyright in their scholarly works. However, please check the relevant policy of your institution.

       b. Open Access Licence to Publish form (all copyright owners sign) 

This Licence to Publish form requires all copyright owners of the paper to sign the form. Please use this form where:

  • the corresponding author does not wish, or does not have authority, to sign on behalf of the other authors; or

  • one or more of the authors do not own the copyright in the paper. This is often the case where an author’s employer owns the copyright in the paper.

As a general guidance, an author’s employer usually owns any copyright in the paper if the author has written the paper within the scope of the author’s employment and the employer organisation is a commercial corporation or Government department or agency. This form may also be appropriate where you are an employee of the United States government and have written the paper within the scope of your employment.

2. Non-open access journal papers

If your paper will not be published as open access, the copyright owner(s) will grant to us an exclusive copyright licence under the relevant Licence to Publish form. The copyright owner(s) retain copyright of their work, but we do grant back to the copyright owner(s) a non-exclusive, non-transferable, royalty-free licence and such terms are set out in the relevant Licence to Publish form and also shown below:

  • use the Work for research, and presentation at meetings and conferences;

  • use the illustrations (line art, photographs, figures, plates) and research data in the Work in their own future works;

  • share print or digital copies of the Work to its employees and subcontractors for their personal use or study;

  • include the Work in part or in full in a thesis provided the thesis is not published for any commercial gain;

  • place the Authors Accepted Manuscript of the Work on a preprint server;

  • place the Authors Accepted Manuscript of the Work on a website administered by the Author, or on PubMed Central, on condition that there is a link to the VoR on the EMAN RESEARCH Publishing website.

You will need to select one of the non-open access Licence to Publish forms.

       a. Non-open access Licence To Publish (corresponding author signs on behalf of all authors) 

This Licence to Publish form can only be used where the corresponding author is the sole author and owns the copyright in the paper, or the corresponding author is one of two or more authors and they jointly own the copyright in the paper.

If one or more of the authors do not own the copyright in the paper e.g., if their employer owns the copyright in the paper, then please see our other form: Non-open access Licence to Publish (all copyright owners sign).

Open Access

EMAN RESEARCH Publishing supports both ‘Green’ and ‘Gold’ Open Access to help authors reach the broadest audience for their work and to facilitate access to scholarly research. Our open access policies are compliant with major funders and the terms of use will vary depending on the Creative Commons Licence selected by the author for Gold Open Access and funder or institutional mandates for Gold or Green Open Access.

We are unable to provide a refund or exchange for products that are not returned in saleable condition.

Use of digital products published by EMAN RESEARCH Publishing is subject to the following terms and conditions.

Copyright

Copyright in the product is the property of EMAN RESEARCH and/or others. The Licensee has the right to make one backup copy of the product.

Transfer Restrictions

Content within the product may be used for the purposes of operating the product only and may not be extracted for any other use. In no event shall the product be transferred, assigned, rented, resold, sub-licenced or otherwise dealt with other than as provided by these conditions. Retransmission, caching or networking of online versions is strictly prohibited, unless negotiated with EMAN RESEARCH Publishing.

Other Restrictions

The Licencee shall not reproduce, disassemble, format, adapt, modify, decompile, reverse engineer, translate or improve the product.

Warranty

If, within fourteen (14) days from the date of delivery, the Licencee returns the product, EMAN RESEARCH Publishing shall either:

  • Replace the product, where the product is defective, or

  • Return the purchase price.

Any replacement of the product will be warranted for another fourteen (14) days.

No Warranty as to Results

EMAN RESEARCH Publishing makes no warrant, promise, representation or undertaking regarding the use of, or reliance upon, the results of the use of the product. In particular, EMAN RESEARCH Publishing does not warrant or represent that any results will be correct, accurate or reliable. Purchasers acknowledge that they have relied upon their own skill and judgement in deciding to acquire the product.

Liability

EMAN RESEARCH Publishing will not be liable for any loss of data, information, revenue, profit or business opportunity or for any loss or damage to goodwill or reputation which is suffered in any way arising from the use of the products.  

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by any applicable law (including consumer guarantees under the Australian Consumer Law) that cannot lawfully be excluded or limited (Non-excludable Term). 

Where permitted by applicable law, and provided it is reasonable to do so, EMAN RESEARCH’s liability for breach of any breach of any Non-excludable Term is limited to repairing the goods, replacing the goods, or the cost of acquiring, repairing or replacing the goods.

Access to Journal Archives

If a subscription lapses, EMAN RESEARCH Publishing will provide customers with access to material for the years in which they held an online subscription. The material will be accessed either from the EMAN RESEARCH Publishing server or from a third party server or by downloading electronic files to the institution´s server.

Access for Remote Users

The following conditions apply to home use and distance education courses at institutions:

  • Remote access is permitted to permanent and visiting staff and students connected via a modem to the institution´s registered IP addresses.

  • Remote access is not permitted from more than one site or campus of a multi-campus institution unless a multi-campus licence is negotiated with EMAN RESEARCH Publishing.

  • Remote access to, and sharing of the online resource among, members of any type of regional consortium is not permitted without prior negotiation with EMAN RESEARCH Publishing.

Authorised Access for Individuals

Individuals have the following access privileges:

  • Individuals must not share their allocated user name and password.

  • Only one concurrent session is allowed with the allocated user name and password.

  • The individual must take reasonable measures to prevent unauthorised use of the allocated user name and password.

Institutions have the following access privileges:

  • Access is granted to permanent or visiting staff, students and walk-in users of the institution´s library and computer networks.

  • The institution must take reasonable measures to prevent unauthorised use of its IP addresses.

  • There is no limit on the number of employees/students from the institution who may use a journal at any one time.
